SUBMISSION

 

Fill out the application form from Clioartfair.com
- Upload art images. Every picture must be max 800 kb. in .jpg, .tiff, .pdf.

- By applying after November 29th, 2024 a $50 (not refundable) Application fee is required. 

Final Exhibition Space Request will be charged accordingly at a rate of: 

GOLD Option:

wall-space(s): US $ 300.00 per foot (width) / floor-space(s): US $ 62.50 per square foot.

PLATINUM Option:

wall-space(s): US $ 350.00 per foot (width) / floor-space(s): US $ 80.00 per square foot.

DIAMOND Option:

ART DEALERS

 

This service is included in the option DIAMOND.

For each sale completed through Clio Art Fair, there is a 20% service fee.

Artist and collective of artists that decide to be the art dealer of themselves will collect the 100% of each sale.

ART HANDLING

Our Art Handling service is $ 70 per foot (width), or $ 17.50 per square foot.

This service is included in the option PLATINUM or DIAMOND.

Our calls for the Clio Art Fair:

are open to emergent dealers, nonprofits, artist-run organizations, collective and solo artists from all over the world. Artists must be 18 years old or older.

Media Accepted are

Photography, painting, sculpture, installation, net art, video, mixed media, design, light art, new media art, comics, drawing, collage, pottery, digital art, printmaking, and sound installation.

SPACE RENTAL AND PAYMENT

 

The Artist leases its own exhibition space at the rental price described on your invoice, exclusive of applicable state and local taxes, plus any booth design extras. 

The Fair does not guarantee specific exhibit space placement, exhibit space configurations or exhibit space footage.

 

The Clio Art Fair Management reserves the right to make changes in exhibit space assignments and square footage allocations within the exhibition at its sole discretion at any time. The square footage is not guaranteed until the final floor plan is complete. 

COPYRIGHT

 

All of the images that you will be submitting are images of original artwork created by yourself or are artworks created by an artist who authorized you to submit the Art on their behalf. 

Artist warrants and represents that Art submitted does not violate the privacy rights, publicity rights, copyright or other intellectual property rights of any person or entity. Artist agrees not to post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

 

Without limiting our rights, it is our policy to terminate all relations with any artist who infringes copyright upon our receipt of a notice of infringement from the copyright owner or the copyright owner’s legal counsel.

PRODUCTION AND
TRANSPORT OF WORKS

 

Artists selected and invited to exhibit will be responsible for the cost of producing, transporting and insuring their works; the address in NYC where the selected artworks are to be sent will be communicated privately to each artist.

CONFIDENTIALITY

 

All financial agreements between Artist and Clio Art Fair are solely between Artist and Clio Art Fair and are considered confidential. Any Breach of confidentiality will result in legal action. 

REFUND POLICY

 

Once the payment of the participation fee is completed, the exhibitor is entitled to request a refund within fourteen (14)  days maximum.

Reimbursement will be made net of $ 150.00 administration fee. 

After fourteen days, payments are final and non-cancellable at any time.

STORAGE (NYC)

Artists who select the PLATINUM or DIAMOND package shall have the option to store their Art with Clio Art Fair free of charge for up to seven days. Artists may be charged a storage fee of fifty dollars ($50.00) per day for each additional day beyond the seven-day storage period. 

 

Artists who select the GOLD package and wish to store their Art with Clio Art Fair will be charged a storage fee of $ 150.00 per box. Artists may be charged a storage fee of fifty dollars ($50.00) per day for each additional day beyond the seven-day storage period. 

ADMISSIONS

Our Curatorial Board will evaluate the artworks based on three criteria:

- Aesthetic quality of work submitted;
- Demonstrable artistic practice;
- Meaningful connection with the Zeitgeist of the present.

 

AUTHENTICITY

All Artists are accountable for the authenticity of their work shown. Should the authenticity of any work or products are shown to be questionable, Clio Art Fair, at their sole discretion, shall have the right to have said work withdrawn from the Exhibition.

 

The Artist shall indemnify and hold Clio Art Fair harmless against all claims whatsoever made with regard to authenticity of any work, or any misrepresentation of any irregularity made with respect to the sale of any artisan or manufactured products at the Exhibition, as well as any expenses incurred by Clio Art Fair, including attorney’s fees.

RESTRICTIONS

All signage and lighting for the Exhibition must be Exhibition standard and approved by Clio Art Fair Management. No Artist will be allowed to mount, display or post non-uniform signage without prior written approval. No unapproved individual Artist lighting systems will be permitted at the Exhibition. Artist agrees to keep its exhibition space open and staffed at all times during the Exhibition hours. Distribution of advertising material and solicitation of any sort shall be restricted to the Artist’s exhibition space. 

 

Artist’s exhibit, products, or signage may not extend beyond the limits of the Artist’s booth space and no part of any exhibit or product may extend into any aisle. Failure to comply with this policy may result in expulsion from the Fair or an additional fee, not less than the cost of an Exhibition space based on the Art displayed and package chosen.

SPACE SHARING

Artists may not assign, sublet, or share any part of their assigned booth without written approval from Clio Art Fair Management. In such cases, there will be a surcharge for an approved Co-Artist to be determined at the time of approval. The Co-Artist will be required to complete and sign an Artist Application.

ARTIST PROMOTION

As an Artist, the Clio Art Fair Management reserves the right to promote your participation through its various marketing channels. These outlets include its social media campaign, outbound email campaign, space ads, mention of the fair’s website, and PR effort.

 

Artist hereby grants Clio Art Fair an irrevocable, worldwide license to use your name, logo, company product/service images, and related appropriate text in its various marketing channels to promote the Fair.

PERSONAL CONDUCT

By participating in the Clio Art Fair, Artist represents and warrants they shall operate in good faith and not act in any way that might adversely affect the reputation of the organization, ownership, the event, or the staff.

 

Without limitation, Artist agrees to provide Clio Art Fair Management with all information as Management may reasonably request with respect to the Package they chose and shall ensure that such information is up to date and accurate. 

EXHIBITION ATTENDANCE

Clio Art Fair Management shall have sole control over admission policies at all times. Artists acknowledge and agree that Clio Art Fair Management makes no representation or warranties with respect to the number of exhibition attendees or the demographic nature of such attendance.

The liability of for failure to perform its obligations under this Agreement is limited to a refund of the Artist’s deposits paid hereunder. Clio Art Fair, in its sole discretion, may cancel this Agreement and the parties hereto shall be released of all further obligations and liabilities.

VISA AND WORKS

The Artist is solely responsible for obtaining passports, visas, and other necessary documentation for entry into the Country or territory where the Fair is held. If Artist and/or its personnel cannot attend the Fair due to a failure to obtain such documentation, the Fees shall remain due and payable in full.

 

Artist is solely responsible for obtaining any licenses, regulatory approvals, customs, clearances, or other necessary consents required for Artist to participate in the Fair and display its Art, including, without limitation, any licenses or other necessary consents required for the playing of music or any other audio or visual material by Artist. 

HARASSMENT POLICY

In the interest of fostering a respectful environment, exhibitors are expected to refrain from any behavior, whether in person, on social media, by email, phone call, or by other means, that may cause offense, annoyance, nuisance, or inconvenience to Clio Art Fair Management, staff, the owner, attendees, or other Artists.

 

Artists should avoid any actions that could harm the reputation of the Clio Art Fair organization, the event, or its ownership. 

LIMITATION OF LIABILITY

Neither Clio Art Fair nor the lessor of the property will accept any responsibility for the well-being of any products or materials that are consigned to or in the possession of any Artist during the Exhibition. The Artist waives any and all claims against Clio Art Fair, its contractors, agents, employees, invitees, sponsors, and the lessor of the property for loss, damage, or destruction by theft, fire, water, extreme heat or cold and other natural disasters of any products or materials in crates, items dropping off the wall, packing materials or any other items of Artist.  Also, Artist waives claims for injury to itself, its agents or employees while on-premises and for any damage of any nature, including damage to its business by reason of the failure to provide exhibition space for its exhibit or for failure to hold the exhibition as scheduled. 

 

All Artist’s personal property of every kind of description which may at the time be in the exhibition space or on premises, shall be at the Artist’s sole risk. Clio Art Fair shall not be liable for any damage or injury caused by another Artist or any person(s) either on the  premises or elsewhere. Clio Art Fair shall not be responsible for damage or loss of property of Artists that is kept in storage while on premises, no matter how it was caused.

INDEMNITY

Artist agrees to indemnify and hold Clio Art Fair, its employees, invitees, sponsors and lessor of the grounds, and their respective officers agents as additional insured and harmless for any claims arising out of negligence of Artist or its employees.

PHOTOGRAPHY, FILMING AND VIDEOS RECORDING RIGHTS

From time to time, photographs, motion pictures and/or video recordings may be made in the exhibition facility and may include images of the Artist, its employees, agents and related displays. Artists may not hinder, obstruct or interfere in any way with such photography or recordings, whether by Clio Art Fair Management or its agents, and hereby consent to  Management’s use of such recordings for commercial purposes.

 

In connection with the other provisions of this paragraph, Artist hereby grants Clio Art Fair Management a non-exclusive, royalty-free, non-transferable worldwide license (without the right to sub-license) to use Artist’s trademarks, service marks, logos, trade names, copyrighted content, hypertext links, domain names, icons, buttons, banners, graphic files and images. Unauthorized photography or video and audio recording of exhibits is prohibited.

INSURANCE

Artists must carry commercial general liability and blanket contractual facility insurance at limits of at least $1,000,000 per occurrence and $2,000,000 per aggregate. A Certificate of Liability Insurance must evidence these coverage plans with a 30-day cancellation provision to the insured and naming Clio Art Fair as an additional insured. 

COVID POLICY

Due to current Covid health safety protocols, Artists have the right to wear or not wear a mask, at their discretion, at all times at the fair.

FORCE MAJEURE

Clio Art Fair is not liable to perform its obligations if such failure is a result of Acts of God, including but not limited to extreme rain storms or heat, hurricane, covid related issues,  or other natural disaster, terrorist activities, government sanction blockage, labor strikes, lockout or interruption of electricity, Clio Art Fair will take reasonable steps to cure and limit damages caused by these unforeseen events and that Clio Art Fair will substantially fulfill all other non-excused obligations. Fair organizers will notify the Artist in a timely manner of the likelihood of an actual occurrence of a force majeure event.

RIGHT TO USE TRADEMARK

By participating in the Clio Art Fair, Artist is granted a limited, revocable license to use the Clio Art Fair name and Logo to promote their Art and Exhibit in the Fair, across their social media channels, website, and other forums. Clio Art Fair reserves the right to require any posts, or media uploaded by Artist, be removed by Artist upon request. 

GOVERNING LAW AND JURISDICTION

This Agreement is governed solely by the laws of New York. In the event of any litigation arising from this Agreement, the parties hereby agree that the sole venue for all legal action shall be submitted to the American Arbitration Association (AAA) for arbitration before a single arbitrator in accordance with the rules of AAA then in force and effect as the sole and exclusive remedy for resolving such disputes. The parties agree that the decision of the arbitrator shall be final and binding and that a judgment may be entered on such arbitration award in any court of competent jurisdiction.

 

The parties agree that any such arbitration shall take place in New York, NY. The prevailing party in any such arbitration shall be entitled to recover its costs and expenses, including reasonable attorneys’ fees, incurred in connection with such arbitration.

 

THE PARTIES ACKNOWLEDGE AND AGREE THAT BY SELECTING ARBITRATION AS THE SOLE AND EXCLUSIVE REMEDY FOR RESOLVING ALL DISPUTES BETWEEN THEM, THEY ARE WAIVING THEIR RIGHT TO A TRIAL TO WHICH THEY MAY BE OTHERWISE ENTITLED.
